Terms of Service

These terms are the agreement between you and the operator of Evoke ("we", "us") covering your use of Evoke at evokestudy.com. By creating an account you agree to them.


Who can use Evoke

You must be at least 13 years old. If you are under 18, you may use Evoke only with the involvement of a parent or guardian. You are responsible for keeping your password secure and for what happens under your account.

Your account

Give us a real email address and keep it current, because it is how we reach you and how you recover your account. Do not share your account with other people. Tell us at evklearning@gmail.com if you think someone else has access to it.

Your content belongs to you

Everything you create in Evoke, your notes, mindmaps, drawings, and images, remains yours. We claim no ownership of it.

You give us the limited permission we need to actually run the service: to store your content, to display it back to you, and to show it to the specific people you choose to share it with. That permission exists only to operate Evoke and ends when you delete the content or your account.

You are responsible for what you upload. Only upload things you have the right to upload. Do not upload other people's copyrighted material without permission.

Sharing

Evoke lets you share topics with other users and post them to groups.

Understand that a share is a permanent copy. When you share, the recipient receives their own frozen copy of that topic at that moment. Changing or deleting your original does not change or delete their copy. If you want to take a share back, delete the share itself.

Anything you share becomes visible to the people you shared it with, and to every member of a group you post to. Do not share anything you would not want those people to keep.

What you may not do

Do not use Evoke to break the law, to harass or threaten anyone, to upload malware, or to share sexual content involving minors. Do not attempt to access other users' accounts or data, probe our systems for weaknesses, scrape the service, or overload it with automated traffic. Do not resell access to Evoke.

If you find a security problem, please email evklearning@gmail.com rather than exploiting it. We will not pursue anyone who reports a genuine issue in good faith and gives us a reasonable chance to fix it.

Service availability

Evoke is a new product built and maintained by one person. It is provided as is, without any warranty. We do not promise it will always be available, error free, or that your data will never be lost.

Please keep your own copies of anything you cannot afford to lose. We take backups and we build carefully, but no small service should be your only copy of important work. This is the single most important sentence in this document.

We may change, suspend, or discontinue any part of Evoke. If we ever shut Evoke down, we will give you reasonable notice and a way to export what you have made.

Limits on our liability

To the fullest extent the law allows, we are not liable for indirect, incidental, or consequential damages, including lost data, lost profits, or lost study time. Our total liability to you for any claim relating to Evoke is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.

Some places do not allow these limits, in which case they apply only as far as the law permits.

Pricing

Evoke is currently free. If we introduce paid plans we will tell you in advance, and anything you have already created will remain accessible to you.

Ending your account

You can stop using Evoke and ask us to delete your account at any time by emailing evklearning@gmail.com.

We may suspend or close an account that breaks these terms, that puts other users at risk, or that we are legally required to close. Where it is reasonable to do so, we will tell you why first.

Changes to these terms

We may update these terms. We will change the date at the top, and for significant changes we will tell you in the app. Continuing to use Evoke after a change means you accept it.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law rules. Any dispute will be handled by the state or federal courts located in Massachusetts.
