Terms of Service
These terms are the agreement between you and Jackson Reyes, the operator of Evoke ("we", "us"), covering your use of Evoke at evokestudy.com. By creating an account you agree to them.
Who can use Evoke
You must be at least 13 years old. If you are under 18, you may use Evoke only with the involvement of a parent or guardian. You are responsible for keeping your password secure and for what happens under your account.
Your account
Give us a real email address and keep it current, because it is how we reach you and how you recover your account. Do not share your account with other people. Tell us at evklearning@gmail.com if you think someone else has access to it.
Your content belongs to you
Everything you create in Evoke, your notes, mindmaps, drawings, and images, remains yours. We claim no ownership of it.
You give us the limited permission we need to actually run the service: to store your content, to display it back to you, and to show it to the specific people you choose to share it with. That permission exists only to operate Evoke and ends when you delete the content or your account.
You are responsible for what you upload. Only upload things you have the right to upload. Do not upload other people's copyrighted material without permission.
Sharing
Evoke lets you share topics with other users and post them to groups.
Understand that a share is a permanent copy. When you share, the recipient receives their own frozen copy of that topic at that moment. Changing or deleting your original does not change or delete their copy. If you want to take a share back, delete the share itself.
Anything you share becomes visible to the people you shared it with, and to every member of a group you post to. Do not share anything you would not want those people to keep.
Publishing a topic is different, and it is public. If you publish a topic to a link, anyone holding that link can read the whole topic without an Evoke account, and nothing stops them passing the link on. A published link shows a frozen copy, so editing the topic afterwards does not change what a reader sees.
Take a link down before you delete the topic it came from. Use "Take the link down" on the topic itself. Deleting the topic does not close the link, because other people may already be relying on it, and once the topic is gone the link is no longer attached to anything you can manage. If that happens, email us and we will remove it for you.
Communities, and content other people post
Communities are shared boards. When you join one you can see topics other members posted, and they can see yours. Those topics belong to the people who wrote them, and we do not check them before they appear.
You are responsible for what you post. Do not post work that is not yours to share, anything confidential, or anything containing another person's private information.
Anyone who can see your post can keep it. Saving a posted topic makes that person their own frozen copy of it. Editing or deleting your post afterwards does not change or remove the copies other people already took. We show how many times a topic has been saved. We never show who saved it.
A community can be opened to anyone with a link. Whoever runs a community can turn on a link that works without an Evoke account. Someone holding it does not see the topics themselves, but they do see the community name, who runs it, how many people are in it, the class names, and for every posted topic its title and the @tag of whoever posted it. Treat the title of anything you post, and the fact that you posted it, as something that may be read by people outside the community.
The person who runs a community decides what happens on it. They can delete any post on their board, stop a member posting, and remove a member. They can also hand the community to another member, so who holds that power may change without your agreement. They are another Evoke user, not us, and we do not supervise the decisions they make on their own board. If you do not want somebody to have that reach over something you wrote, do not post it there.
If you see something that should not be there, use the Report control on the post. A report goes to us and to the person who runs that community, except a report about that person's own post, which comes only to us. We keep a record of what was reported, including a copy of the reported content, so that we can look into it after the post itself is gone. We can remove any post from any community, and we can suspend an account that keeps posting things it should not. We do not promise to review everything, and removing something is not us taking a view on who is right.
Copyright complaints
If you believe something on Evoke infringes your copyright, tell us and we will take it down while we look into it. Send a link to the post, a description of the work you own, and how to reach you.

We end the accounts of repeat infringers. If somebody posts other people's copyrighted work more than once, we close their account, and in clear cases we will do it the first time.
What you may not do
Do not use Evoke to break the law, to harass or threaten anyone, to upload malware, or to share sexual content involving minors. Do not attempt to access other users' accounts or data, probe our systems for weaknesses, scrape the service, or overload it with automated traffic. Do not resell access to Evoke.
If you find a security problem, please email evklearning@gmail.com rather than exploiting it. We will not pursue anyone who reports a genuine issue in good faith and gives us a reasonable chance to fix it.
Service availability
Evoke is a new product built and maintained by one person. It is provided as is, without any warranty. We do not promise it will always be available, error free, or that your data will never be lost.
Please keep your own copies of anything you cannot afford to lose. We take backups and we build carefully, but no small service should be your only copy of important work. This is the single most important sentence in this document.
We may change, suspend, or discontinue any part of Evoke. If we ever shut Evoke down, we will give you reasonable notice and a way to export what you have made.
Limits on our liability
To the fullest extent the law allows, we are not liable for indirect, incidental, or consequential damages, including lost data, lost profits, or lost study time.
There is also a ceiling on what we could ever be made to pay. If a claim against us succeeds, the most we can owe you in total is fifty US dollars. If you have paid us more than that in the twelve months before the claim, the ceiling is the amount you paid instead.
Some places do not allow limits like these. If you are in one of them, they apply to you only as far as your local law permits.
Pricing
Evoke is currently free. If we introduce paid plans we will tell you in advance, and anything you have already created will remain accessible to you.
Ending your account
You can stop using Evoke and ask us to delete your account at any time by emailing evklearning@gmail.com.
We may suspend or close an account that breaks these terms, that puts other users at risk, or that we are legally required to close. Where it is reasonable to do so, we will tell you why first.
Changes to these terms
We may update these terms. The date at the top always shows when they last changed, so it is worth looking now and then. Continuing to use Evoke after a change means you accept it.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law rules. Any dispute will be handled by the state or federal courts located in Massachusetts.
